Indiana resident, David Bailey, failed to appear at his trial for assaulting a minor and is now wanted by law enforcement in Johnson County, Indiana.
David Bailey was charged in relation to an incidents that took place between 2019 and 2021. He was accused of having sexually assaulted a teenager. Bailey posted bond in February of 2023 and was released from custody and ordered to have no contact with the victim. He was also ordered to appear at every court hearing for his case.
David Bailey chose to take his case to trial and was granted the use of a public defender who asked the court for multiple delays and more time. His requests for more time stretched into this summer, more than a year after his initial charges in January of 2023.
The final trial date was rescheduled to August 6, 2024 with pre-trial discussions and motions hearings taking place in July. During a July motions hearing just before trial, David Bailey was not present in court. His legal counsel appeared, but Bailey did not.
The court requested a warrant to be issued for Bailey’s arrest with no bond. By the first day of trial on August 6, Bailey was still not present in court. The trial continued in his absence and the jury found him guilty in less than 40 minutes.
Sentencing is scheduled for September 6, 2024. Bailey is facing up to 12 years in prison.
